Sub: Seeking information on the latest status of all pending Court/CAT cases on the issue of extension of benefit of clause l(x)(e) of Ministry of Finance Resolution No. l/01/2008 IC dated 29.08.2008 (grant of Non functional Scale of GP Rs.5400/-) in respect of similarly placed officers of Department of Posts in term of order of Hon'ble Madras High Court dated 06.09.2010 in WP No. 13225/2010 (case of Shri M. Subramaniam) - reg.
Sir/ Madam, This refers to this office letter of even No. dated 10.02.2022 on the above noted subject. The latest status of all pending as well as implemented Court/CAT cases, on the issue, in details and updated financial implication involved in each case till date was requested in the prescribed format (Annex-I), but no response has been received so far.
2. Some units have furnished a Nil report intimating that there is no Court/CAT case on the issue. In this context, it is bring to notice that, since the Orders dated 02.12.2021 of Hon'ble CAT Bench Hyderabad in Original Application No.506/2021 filed by IP/ASP Association, covers all the IP and ASP of respective Circle / administrative unit, who have completed 4 years service in Grade Pay Rs.4800/- with/or corresponding Levels, granted by either mode MACP or substantive, financial implication in respect of such officials is also required.
3. Since, the requisite information is needed on an urgent basis, kindly provide the same, duly approved by HOC, by 10.03.2022
