Chargesheet on R N Parashar -Ex Secretary General NFPE | President has ordered to drop the disciplinary proceedings initiated under Rule 14 of CCS (CCA) Rules,1965

Shri R.N. Parashar, Ex-PA Mathura Division, Mathura, U.P. Circle, the charged Official (CO), was proceeded under Rule 14 of CCS (CCA) Rules, 1965 by SSPOs Mathura Division (Disciplinary Authority) vide Memo No. Bla/Dis/ R.N. Parashar/2020-21 dated 29.12.2021 alleging that Shri R.N Parashar, LSG (NB), PA Mathura HO, Mathura while himself working as Secretary General, National Federation of Postal Employees at Central Headquarter of the Federation (on deputation of Foreign Service) sent letter number PF-O8/2016 dated 07.06.2016 and letter no. PF-08/2019 dated 11.06.2019 to the Chief PMG, U.P. Circle, Lucknow for extension of his own deputation to foreign service w.e.f. Ol.O7.2016 to 30.06.2019 and 01.07.2019 to 31.12.2021 respectively 

allegedly concealing the fact that he is already and continuously on foreign service since 01.08.2010 and while as per DoPT OM No. 2/6/2016-Estt (Pay-II) d,ated 17.02.2016, the maximum period of tenure of deputation/ foreign service was fixed for 07 years only. 

The said Shri R.N. Parashar is working on deputation to Foreign Service for over 10 years at a stretch. Thus on the basis of allegedly concealing the above fact of being himseif working on foreign service since 01.08.2010 in the letter issued in his own signature, the said Shri R.N. Parashar managed to get the extension for deputation to foreign service beyond the maximum period prescribed as per DOPT OM No. 2 /6/2016-Estt (Pay-II) dated 17.02.2016 and therefore it is alleged that by acting in the aforesaid manner the said Shri R.N. Parashar violated the provisions of DoPT OM No. 2/6/2016-Estt (Pay-II) dated 17.02.2016 and also acted in a manner of unbecoming of Government Servant and thereby he is alleged to have infringe the Rule-3 (i) (iii) of CCS (Conduct) Rules, 1964.

As the charged official retired on superannuation on31.12.2021, hence the disciplinary proceedings automatically converted to Rule 9 of CCS (Pension) Rules, 1972 (Rule B of CCS (Pension) Rules, 2021). The CO submitted his representation dated 03.01.2022 against the charge sheet under which he explained each and every details & procedure of extension of foreign service which was granted and approved by the Chief Postmaster General, Lucknow. AII the Memos of grant of extension were appended by him.

3. The Chief Postmaster General, UP Circle has stated that the charged official Shri R.N. Parashar has not concealed any fact while seeking extension of Foreign Service w.e.f. 01.07.2019 to 31.12.2021 and applied the extension of Foreign Service in prescribed form ald furnished all the details. Charge sheet under Rule-14 of CCS (CCA) Rules, 1965 converted to Rules of CCS (Pension) Rules, 1972 (Rule 8 of CCS(Pension) Rules, 2021) issued by the Disciplinary Authority is not justified. Hence, Chief Postmaster General, UP Circle proposed to drop charge-sheet issued to Shri R. N Parashar (CO).

4. The case has been examined and it is established that no information/facts were concealed by Shri Parashar and his all deputation to Union as office bearer was approved by the competent authority as per existing rules/ guidelines and no violation of these guidelines was committed by the CO.

5. The President, after considering the records of the case observed that the Charges against the CO are not sustainable Hence, President has ordered to drop the disciplinary proceedings initiated under Rule 14 of CCS (CCA) Rules,1965 and converted to Rule 9 of CCS (Pension) Rules, 1972 (Rule 8 of CCS (Pension) Rules,2021) against the CO i.e. Shri R.N. Parashar. By order and in the name ofthe President.
