Subject: - OAs filed in connection with the LDCE for promotion to the cadre of Inspector Posts for the vacancies of 2019, 2020 and 2021.


Madam / Sir,


Based on the references received from Circles eligibility service condition for Limited Departmental Competitive Examination (LDCE) for Inspector Posts cadre for the vacancy year 2019, 2018 & 2021 was provisionally relaxed for all officials, who were holding the post in feeder grades, as per the Department of Posts (inspector Posts) Recruitment Rules, 2013 as on the date of notification of Department of Posts (Inspector Posts) Recruitment Rules, 2019 i.e. 05.02.2019 and have completed 5 years of eligible service as on the crucial date of eligibility, to appear in the examination provisionally subject to concurrence by the DoP&T.


2, The matter was referred to DoP&T for concurrence. However, DoP&T has not agreed to with the proposal of Department of Posts. Following observation has been made by the DoP&T: -


i, The provision of Protection clause, as provided under para 3.1.3 of DoP&T’s OM No. AB.14017/48/2010-Estt.(RR) dated 31.12.2010 is applicable only in -cases wherein the eligibility of service is being enhanced in pursuance of guidelines issued by this Department subject to other conditions remaining the same. However, in the case of IP, the pay level of the post has been upgraded, corresponding changes need to be incorporated the eligibility service for promotion. Therefore, provision of protection clause cannot be applied in this case. It has been observed that official in Level-6, Level-5 and Level-4 of pay matric are eligible to appear in LDCE for the post of IP (Level-7). Moreover, at the time of last amendment carried out by DOP, provision of 8 years service in the feeder grades for appearing in LDCE was agreed to by this Department in March 2018, after due deliberation and  same was agreed to by the UPSC also


ii. Hence, the proposal of DoP, to allow all officials, who were holding the post in feeder grades, as on the date of notification of Department of Posts (Inspector Posts) RRs, 2019 and have completed 5 years of eligibility service as on the crucial date of eligibility to appear in the LDCE, as per the earlier RRs, is not agreed to. Further, DOP is also advised to defend the case based on above facts, in consultation with DoLA.


3. In view of the observation of DOP&T, it may be noted that the post of Inspector Posts has been upgraded from Level-6 (GP Rs. 4200/-) to Level-7 (GP Rs. 4600/-). Therefore, the eligibility service condition has been enhanced from 5 years to 8 years.


4, This will be brought to the notice of all concerned. Any court case coming up in this reference will be defended accordingly
